Parties and scope

This Service Agreement ("Agreement") is between Upper Echelon Automotive ("UEA," "we," "us") and the person booking service ("Customer," "you"). It applies to all diagnostic, repair and maintenance work we perform on your vehicle at the location you choose.

UEA is a mobile service. We bring tools and parts to your vehicle. We do not take possession of or tow your vehicle unless you agree to that separately in writing.

Authorization and estimates

We only perform work you approve. Before any repair begins, we give you a written estimate of parts and labor, and you approve it by signature, typed name or written reply.

  • New findings. If we find another problem during the job, we stop and get your approval before doing any additional work.
  • Estimate changes. If the approved work will cost more than the estimate, we tell you the new amount and get your approval before continuing.
  • Declined work. If you decline a recommended repair, we note it on your record. We are not responsible for problems caused by repairs you declined.

Diagnostic and rush fees

FeeAmountWhen it's dueRefundableApplied to repair
On-site diagnostic$100At the appointmentNo, once the technician arrivesNo
Rush / priority dispatch$100Online, when you bookNoNo

The diagnostic fee covers the technician's trip, time on site and use of diagnostic equipment. You owe it whether or not you approve a repair.

The rush fee reserves priority same-day dispatch. It is not refundable, including if you cancel. If UEA cannot provide the rush service you booked, we refund the rush fee.

Payment terms

What you pay up front depends on the job's approved estimate and who supplies the parts.

SituationPaid when you sign the estimatePaid at completion
Job under $499, customer-supplied partsNothingFull balance
Job under $499, UEA-supplied partsFull parts costLabor and remaining balance
Job of $499 or moreRetainer of 50% of the estimated total (non-refundable)Remaining balance
  • Retainer. For any job with an approved estimate of $499 or more, you pay a retainer of half the estimated job total before work is scheduled. The retainer is non-refundable once paid, except as stated in section 5. It is credited toward your final invoice.
  • Parts. When UEA supplies parts, you pay for them when you sign the estimate, through the separate payment link we send you. We order parts only after that payment is received. On jobs of $499 or more, the parts payment counts toward the 50% retainer.
  • Balance. The remaining balance is due when the work is complete, before the technician leaves.
  • Methods. Major credit and debit cards, cash, Zelle, Venmo and Cash App.
  • Fleet accounts. May be invoiced on net terms set out in a separate fleet agreement.

You can cancel free of charge up to 48 hours before your appointment time.

  • A no-show means the vehicle or the customer is not available at the booked location within 30 minutes of the appointment time.
  • Rescheduling 48 hours or more before the appointment is free and keeps your retainer on file for the new date.

Parts

UEA-supplied parts. We order parts after you pay for them (section 4). Once ordered, parts payments are not refundable. If a part arrives wrong or defective, we replace it at no extra cost to you.

Customer-supplied parts. You may supply your own parts. When you do:

  • You are responsible for the part being correct, new or in working condition, and compatible with your vehicle.
  • UEA gives no warranty on the part or on the labor to install it (section 7).
  • If the part is wrong or fails during installation, the labor already performed is still owed, and any return visit is billed as a new appointment.
  • We may decline to install a part we believe is unsafe, worn out or counterfeit.

Warranty

UEA warrants parts we supply and the labor to install them for 90 days from the date the work is completed. Customer-supplied parts and the labor to install them carry no warranty.

What we do. If a covered part or our workmanship fails within 90 days, we repair or replace it at no charge for those parts and that labor. Call (251) 289-0740 to start a claim. We inspect the vehicle before any warranty work.

What the warranty does not cover:

  • Customer-supplied parts, or labor to install them
  • Diagnostic fees and rush fees
  • Damage from accidents, misuse, racing, overheating, lack of maintenance or modifications
  • Work done or attempted by anyone other than UEA on the same repair
  • Other parts of the vehicle that fail and were not part of the repair
  • Towing, rental cars, lost time or other costs, unless required by law

A part manufacturer's own warranty may last longer than 90 days. We will help you file a manufacturer claim, but labor after our 90 days is billed normally.

Work location and vehicle condition

Location. You confirm that you have permission to have work done on the vehicle at the service location, including any apartment, HOA, employer or property-owner rules. You provide a reasonably level, safe spot with room to work. We may decline or stop work at any location that is unsafe, including busy roadsides, severe weather or an unsafe surface. If we cannot work safely on arrival, the diagnostic fee still applies.

Vehicle condition. You confirm you own the vehicle or are authorized by its owner to approve work on it. We are not responsible for existing damage or wear, including rust-seized or brittle bolts, sensors, connectors and plastic parts that break during normal removal. If that happens, we tell you and quote any extra parts or labor before continuing. We may photograph the vehicle before and after work for our records.

Jobs that can't be finished on site. Some jobs need a lift or a shop. If a job cannot be done safely or completely on site, we stop and tell you. You pay for the diagnostic and any approved work already completed. If a part must be ordered, we schedule a return visit, and the rest of the job follows this Agreement.

Liability, communication and general terms

Liability. UEA carries commercial insurance. Our responsibility for any claim related to our work is limited to repairing or replacing the work we performed, or refunding what you paid for it, to the extent the law allows. Nothing in this Agreement limits rights you have under Texas law that cannot be waived.

Texts and calls. By booking, you agree that UEA may call or text the number you provide about your appointment, estimates, job updates, payment and review requests. Message and data rates may apply. Reply STOP to stop texts. You will still get calls about an open job.

Changes. This Agreement is the version shown when you booked. Any change to the work, price or terms must be approved by you in writing. Text or email counts.

Governing law. This Agreement is governed by the laws of the State of Texas. If any part is found unenforceable, the rest still applies.
